ISP業者にとって福音＞罰則規定強化
ISP 業者の立場から。今回の法律改正は ISP に大きなメリットがあります。ISP (インターネット・サービス・プロバイダ)にとって、迷惑メールを発信しているサーバが特定できていても、利用規約の関係で、なかなかサーバ停止に踏み切れない場合もあったと思うのです。
今回の法改正によって「企業向けのダイレクトメール」にも"未承諾広告※"の記述が必要になります。
加えてなんと、「メールサービスに支障が出るのを防ぐために正当な理由がある場合」にメールサーバの停止をさせる事も出来るようになります。その正当な理由の中には、無作為に送られる迷惑メール(SPAM)の影響でメールサービスに支障が出るため「事前に」防ぐ事もできそうです。
ということは、ホスティング・レンタルサーバ業者にとっては「いかにも SPAM 送ってるだろ、オマエモナー」というサーバがあれば、即時停止が出来るかもです。アメリカではありませんが、平和維持のための先制攻撃が許される事に。。。
（法律に詳しい方、私が勘違いしてましたら、どうぞツッコミをお願いします(^^;;）
ちなみに、今回は罰則も強化されて、１年以下の懲役か 100 万円だそうです。100 万円なら安いと考える業者もいると思うのですが……。ま、それはそれで……。

The penal regulations regulations strengthening is gospel for the ISP trader.
A new law to prevent the spam mail in Japan was approved.
I am related to the ISP entrepreneur. It gives one's views from my standpoint. This law revision has a big advantage in ISP. Even if the server that sent the spam mail was able to be specified for ISP (Internet Service Provider), it might not be able to launch out into the server stop easily because of the agreement for use.
The description in "Advertisement for which it doesn't hope" and the mail title is needed in "Corporate direct mail" by this law revision.
ISP can stop the mail server when there is a good cause to prevent the mail service being hindered. To hinder the mail service because of spam mail (SPAM) sent at random, it seems to be able to prevent "Prior" in the right reason.
Really SPAM there is a possibility that the immediate end can be done if there is a server named sending. To the thing that the preemptive strike for peacekeeping is permitted though it is not the United States...
By the way, penal regulations was strengthened this time. The penal servitude of one year or less or the penalty seeming is one million yen when illegal acting. Though thought that there is a trader who thinks it is cheap if the penalty is one million yen, too.
